These Terms & Conditions govern your use of GOWISHER and the services provided by us. By using our website and our services, you understand our Terms & Conditions and accept them as a legal binding contract. We may change these Terms & Conditions at any time based on our discretion.

Products and Pricing:

  • The number of products on the website, product descriptions & prices may change from time to time.
  • Buying of a product on the website is subject to availability of product in current stock.
  • GOWISHER may, at any time without notice, modify, or stop selling any product or services.
  • In case a product or service is listed with incorrect information in terms of price, size, or any other information, due to typing errors or incorrect information received from suppliers of GOWISHER, GOWISHER shall have the right to decline or cancel any such order, even after you placed an order and paid for it & order confirmation by us. We will refund the money, if you have already been charged for the order and thereafter GOWISHER cancels your order.
  • The product specifications (weight, size, color etc.) mentioned are only approximate and may vary from the actual product, or the product photos. 
  • We may provide either printed or handwritten messages, on the complimentary message cards that come along with gifts, based on our convenience.

Orders and Acceptance of Orders:

Even if you placed an order or made an offer to purchase, the confirmation of your order is based upon our discretion. Even after you get an order confirmation (email/SMS/push notification), it neither indicates our acceptance of your order nor our offer to sell. GOWISHER reserves the right to accept or decline your order, for any reason at any time, after receiving your order, whether in whole or in part. You might even be required to provide more verifications or information before we confirm your order. When you make a purchase, you need to provide the correct name and shipping address of the recipient.

In case GOWISHER cancels all or a part of your order, you will have only one of the following resolutions:

  • If your account has already been charged for the cancelled order or cancelled portion of the order, GOWISHER will credit the amount charged for the cancelled order or cancelled portion of order into your debit card/ credit card/ bank account, OR
  • GOWISHER will not charge you for the cancelled order or the cancelled portion of the order into your debit card/ credit card/ bank account.

Note that GOWISHER accepts various types of payment methods including debit card, credit card, net banking, wallet, UPI, etc. All the payments are subject to the terms and conditions of third-party payment gateways, whether they are made through payment gateway on the GOWISHER website or through the GOWISHER mobile application, and may be subject to change.

Substitution Policy:

  • Flowers: Both the flowers and flower arrangements may vary slightly from the picture shown. Sometimes, due to lack of availability of the ordered flower or floral arrangement, we might even have to substitute the flowers or flower arrangements.
  • Cakes: All the cakes may slightly vary in design, colours shape from what has been shown on the website. Sometimes, due to unforeseen circumstances we might have to substitute designs, flavours, colours, shape etc. based on availability. But we will try to provide a close substitute to the product you ordered based on availability and acts of God. In case of a product you ordered being unavailable, we will try to contact you and give you alternate options. However, we would send a product based on our discretion if we are unable to contact you.

Order Modification/Cancellation Policy:

  • GOWISHER reserves the right to not accept orders or cancel orders from our side due to many reasons like Acts of God, unforeseen circumstances, products being out of stock, mistakes with a listing of product or product information or prices, etc. For that, GOWISHER needs details and information before accepting any order. 
  • GOWISHER currently doesn’t allow the cancellation of orders. In the future, if we allow the same, we will try to contact you through email, phone, SMS, before canceling an order. If we are unable to contact you, we will proceed with the cancellation.
  • When it comes to modification of orders, we only allow modification of orders if the product has not yet been prepared, or if work on the product has not yet started. Once the product has been finished, the modification option is disallowed.

Order/Delivery Confirmation E-mail:

  • After you place an order, and the payment process has been done, you will get an order confirmation email from gowisherteam@gmail.com. It will contain the basic details of your order, including order number, etc.

Shipping & Delivery Policy

Product delivery will vary depending on various factors such as location, weather, accessibility, unforeseen situations, etc.

  • The delivery date and delivery time given by us is only an estimate and is not exact. It is dependent on various factors such as product availability, Acts of God, accessibility to destination, vagaries of weather, unforeseen circumstances, etc. Therefore, it is non-binding and we will not be liable to any refunds, cancellations, etc. In case of delay in delivery, we would try to contact you.
  • Our suggestion would be to place your order at least 5 days in advance.
  • In case of any dispute, we will provide the proof of delivery.
  • We will try to attempt delivery of your perishable products, like cakes and flowers only once and redelivery will not be done. If the delivery has not been completed in that one attempt, you will still be charged for it.  
    • if a wrong shipping or delivery address has been provided, OR if the recipient is not available, OR if the recipient refuses to take the order, OR if the premises is locked, we will think of the order as executed. 
    • We request those who place the order to ask the recipient to tell  to deliver to someone else such as a neighbour/ watchman, etc. if the recipient is not available.
  • Deliveries will be made only on working days.
  • In case of a recipient not being available at the time of delivery, then that shall not be counted as late delivery and we will not be liable to any refunds, cancellations, complaints, etc.

Delivery of Courier Products:

    • GOWISHER does not make any representation or warranty with view to the delivery of such order in the event the order is made to deliver through any courier agency or any third party.
  • The delivery of our products will be made through any of the courier companies and the deliveries are subject to the terms and conditions. 
  • The date and time of products delivered through our courier partners are an estimate only. The estimated dates are dependent on various factors such as weather, accessibility of destination, strikes, holidays, curfews, act of god, situation in the region, etc. Exact delivery might not be possible and your order might be delivered before or after your selected date of delivery. You agree that the chosen delivery date is non-binding and that we are NOT liable to you in any way whatsoever.
  • Caution: Since courier companies do not call before delivering an order, it is prudent for you to provide a shipping address where somebody is there to receive the order. If nobody is there to take the delivery, the delivery will not be redirected to any other address.
  • Courier companies deliver only on working days. 
  • Occasionally, there might be some delay from our courier partners due to unforeseen events

Note:

  1. Our courier partners will only attempt delivery only twice if the recipient is unavailable. In case of incorrect delivery location or refusal by the recipient to take the delivery, the order will be thought as made. After two unsuccessful attempts at delivery, our courier partner will bring back the package and you shall be charged for it nevertheless.
  2. If a wrong shipping or delivery address has been provided to us, OR, if the recipient is not available, OR, if the recipient refuses to take the order, OR, if the premises is locked, we will consider the order executed.
  3. We request those who place the order to ask the recipient to tell to deliver to someone else such as a neighbour/ watchman, etc. if the recipient is not available.

Delivery Policies:

These are the specific policies applicable to certain locations or places.

  • Hospitals:
    • In case of delivery at a hospital, please make sure to mention the city, hospital name, full address, telephone number of the hospital, recipient name, room or ward number of the recipient.
    • Based on the hospital procedures, we will attempt your delivery. However, our courier company partner cannot attempt direct delivery in hospitals due to hospital rules. In some cases such as when the recipient is an ICU, delivery will not be possible.
  • Hotels:
    • In case of delivery at a hotel, please make sure to mention the city, hotel name, full address, telephone number of the recipient and telephone number of the hotel, recipient name, room number of the recipient, name of tour company, etc.. 
    • The order will be considered executed if the recipient was not checked in at the hotel on the delivery date, OR if the recipient has already checked out by the time of delivery; therefore, GOWISHER is not liable to refunds, cancellation, etc.
  • Weddings & Marriage Halls:
    • When it comes to wedding ceremonies/ or marriage halls, GOWISHER does not guarantee delivery of product to the bride and/groom. We would attempt to deliver to a responsible from member of host. 
    • We don’t accept any liability with regards to rufunds, returns, cancellations, complaints, etc. in case the gift doesn’t reach the recipient.
  • Hostels & Enclosed Places:
    • In case of delivery at Hostels/PG/Cantonment/Enclosed Premises, please make sure to mention the city, Hostel name, full address of the hostel, telephone number of the recipient and the hostel, the name of the recipient, room number of the recipient, etc. and whether the recipient will come to the gate and take the delivery or send someone on their behalf.
    • Any order delivered with the reception or at the gate or with any responsible person will be considered executed.
  • Remote Locations and Towns:
    • We provide services in selected locations in selected cities only.
  • We provide only an estimate and approximate time and date of delivery. The delivery time and date may vary depending on various factors including unforeseen events, acts of god, weather, situation, location, etc.
  • If you provide incorrect name or incorrect shipping address, it is your sole responsibility.
  • We deliver only on working days. In the event of acts of God or unforeseen events like floods/ heavy rains/ National Bandh/election dates/ curfews/ traffic jams/ festival times/regulated traffic movements or any other impediments, the delivery of order might be delayed. GOWISHER reserves the right to reschedule the delivery to another date.
  • We will attempt the order delivery only once as provided in the order received by GOWISHER. In case the delivery doesn’t get executed due to reasons not attributable to  GOWISHER, we will not do redelivery or refund to the customer and the customer will still be charged.
  • The after selfie considered executed in case the delivery is not done due to the following reasons such as: wrong address. Recipient not available. Premises locked. Wrong/incorrect phone or mobile or extension number / not working / no reply or not connecting /not reachable, . Recipient refused the products. Delivered the product at the Gate/Reception/Neighbourhood.

Duplicate Orders:

  • In the case of placing two orders by mistake, if you tell us before the preparation of the product or dispatched, we will give you a refund for the duplicate order, subject to our satisfaction. 
  • In case we suspect a duplicate order and try to contact you with the contact details given by you and if you are unreachable, then we will take a decision based on our discretion and it is final. We shall not be liable for refund, complaint, cancellation, etc.

Payment Terms:

  • When you buy a product or service on our website, you agree to pay the price applicable at the time you submitted the order (Product Price) for the product or service, the delivery fees (Delivery Fees) for the delivery product or service you select, or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on GOWISHER’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services (Taxes) not withheld by GOWISHER
  • You agree to pay the price applicable for the product or service on our website at the time you submitted your order (Product Price), the delivery fees for the delivery service you select, if any (Delivery Fees), or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on GOWISHER’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services (Taxes) not withheld by GOWISHER.
  • All payments are non-refundable (except as expressly set forth in the Terms and Conditions). We reserve the right to charge late fees on all due payments equivalent to the lesser of 1.5% per month on the unpaid balance or the highest rate allowed under Applicable Law. You agree to pay for all collection costs, attorney’s fees, and court costs incurred in the collection of past due amounts.
  • Discounts are applicable only on a minimum cart value of Rs. 500 and above.
  • “Convenience Charge” has been levied by the company for the facilitation of choosing a product/s and book for delivery, anywhere in India, without visiting our physical store. This covers company’s Internet and system handling costs.
  • Such Convenience charges are correlated to the Order value.

Communications:

  • You agree to receive communications from us by e-mail, SMS or any other communication made electronically, verbally or physically through post. You agree that all agreements, notices, disclosures and other communications that GOWISHER provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing.
  • In some cases, we will be contacting the recipient before delivery. If you wish we do not contact the recipient, please call our Customer Care at +919676949848 between 8AM and 10 PM, and notify them about the same.
  • Since we are in an occasion based gifting business, we would like to remind you in future year(s) for the same occasion. You give your consent for us to contact you through SMS, phone call and email on your registered phone number and email id, to assist you with our free Occasion Reminder Service.

Feedback and Suggestions:

  • At GOWISHER, we make every effort to ensure that you receive excellent products and services. We strive hard not only meet, but exceed your expectations. If, at any time, you experience problems with an order or are not happy with our service, you can write to us at gowisherteam@gmail.com , or call our Customer Care at +919676949848 between 8 AM and 10 PM.
  • Your feedback and suggestions are important to us.
  • Note: Complaints need to be made within 2 days from the time of delivery, after which we will not be able to register any complaints. Complaints against non-delivery needs to be made within 15 days from the date of delivery, after which we will not be able to register any complaints. In case of a defective or a bad quality product complaint, we will replace it. For quality purpose, we might have to get a reverse pick up done for that product, before we can get a redelivery done.
